Article 1 – Definitions
In these general terms and conditions, the following definitions apply:
Consumer: any natural person who acts for private purposes and not in the exercise of a profession or business.
Entrepreneur: Lara Boutique, located at Spilstraat 5, 6211 CN Maastricht.
Agreement: any agreement between Lara Boutique and the consumer concluded via the webshop
Product: all items offered by Lara Boutique.
Right of withdrawal: the consumer's legal right to return an online purchase within the statutory period.
Cooling-off period: the statutory period of 14 days during which the consumer can exercise the right of withdrawal.

Article 3 – Applicability
1.These general terms and conditions apply to all offers, orders, and agreements of Lara Boutique.
2.By placing an order, the consumer agrees to these general terms and conditions.
3.Deviations from these terms and conditions are only valid when agreed upon in writing.
4.If one or more provisions prove to be invalid, the remaining provisions will remain fully in effect.
Article 4 – The offer
1.Lara Boutique takes great care in presenting its products.
2.Images provide the most realistic possible representation of the products. However, colors may vary due to screen settings.
3.Obvious errors, printing errors, or pricing errors are not binding on Lara Boutique.
4.All prices include VAT and exclude any shipping costs, unless stated otherwise.
5.If a product is temporarily unavailable, this will be indicated as clearly as possible.
Article 5 – Formation of the agreement
1.An agreement is concluded as soon as the consumer has placed an order and it has been confirmed by Lara Boutique.
2.Lara Boutique reserves the right to refuse an order if there is a valid reason, for example, in case of an obvious error or suspected fraud.
3.After placing an order, the consumer will receive a confirmation by email.
4.Lara Boutique takes appropriate technical and organizational measures to process personal data and payments securely.
Article 6 – Right of withdrawal
1.For an online purchase, the consumer has the right to withdraw from the agreement within 14 days after receiving the order without giving any reason.
2.During the cooling-off period, the product must be handled with care. The product may only be used to the extent necessary to determine its nature, characteristics, and functioning.
3.The consumer must register a return within the cooling-off period via Lara Boutique's return portal.
4.After registering the return, the product must be returned within 14 days at the latest.
• 5. Products must be returned complete, unworn, undamaged, and with original labels and packaging.
Article 7 – Costs in case of withdrawal
1.When the consumer exercises the right of withdrawal, the costs for returning the products are for the account of the consumer, unless otherwise agreed.
2.After receipt and inspection of the returned products, Lara Boutique will refund the purchase amount within 10 working days at the latest. Lara Boutique may wait with repayment until the products have been received.
3.The refund will be made via the same payment method used for the original payment, unless the consumer explicitly agrees to a different payment method.
4.If the product has been used more than necessary to determine its nature, characteristics, and functioning, Lara Boutique reserves the right to charge for any depreciation in value or to refuse the return.
Article 8 – Exclusion of the right of withdrawal
The right of withdrawal can only be excluded for products for which this is legally permitted. This applies, among other things, to:
products made specifically according to the consumer's wishes or specifications;
products that cannot be returned for hygienic reasons and whose seal has been broken after delivery;
products that cannot be returned due to their nature;
products that spoil quickly or have a limited shelf life.
Article 9 – Prices
1.All prices on the website are stated in euros and include VAT, unless otherwise indicated.
2.Any shipping costs will be clearly stated before the consumer completes the order.
3.Lara Boutique reserves the right to change prices. Price changes do not affect already confirmed orders.
4.Obvious printing, typesetting, or pricing errors are not binding. Lara Boutique reserves the right to cancel an order if there is an obvious error.
Article 10 – Warranty and conformity
1.Lara Boutique guarantees that the delivered products comply with the agreement and with the reasonable requirements of quality and usability that the consumer can expect.
2.If a product is damaged or incorrectly delivered, we ask the consumer to report this to us as soon as possible, and at the latest within 5 days after receipt, via info@laraboutique.nl
3.The warranty expires if damage is caused by improper use, normal wear and tear, careless handling, or repairs not performed by Lara Boutique.
Article 11 – Delivery and execution
1.Lara Boutique processes and ships orders with the greatest possible care.
2.Orders will be delivered to the delivery address specified by the consumer or can be picked up in the boutique if this option was chosen during checkout.
3.We aim to ship orders as quickly as possible. The stated delivery times are indicative and no rights can be derived from them.
4.If an order is unexpectedly delayed or a product proves to be unavailable, the consumer will be informed of this as soon as possible.
5.If an order cannot be executed, the consumer is entitled to a refund of the amount already paid.
6.The risk of loss or damage to an order transfers to the consumer as soon as the order has been delivered to the specified address or has been picked up.
Article 12 – Continuing performance contracts
Lara Boutique sells products through one-time purchase agreements. If Lara Boutique offers subscriptions or other continuing performance contracts in the future, the legal provisions applicable at that time will apply.
Article 13 – Payment
1.Payment must be made via one of the payment methods offered in the webshop during checkout.
2.Lara Boutique uses a secure payment environment via Mollie.
3.An order will be processed after payment has been successfully received or authorized.
4.The consumer is obliged to report inaccuracies in provided or stated payment details to Lara Boutique as soon as possible.
5.If a payment is unjustly reversed or not made, Lara Boutique reserves the right to cancel the order or suspend further delivery, to the extent permitted by law.
Article 14 – Complaints
1.Lara Boutique does its utmost to handle every order to satisfaction.
2.Do you have a complaint? Please contact us as soon as possible via info@laraboutique.nl. Describe the complaint as fully as possible and include photos so that we can help you as best as possible.
3.We aim to respond substantively to complaints within 14 days of receipt. If more time is needed, we will inform you about this.
4.If we cannot resolve it together? Then as a consumer within the European Union, you can use the European Commission's Online Dispute Resolution (ODR) platform, to the extent that this platform is available and applicable.
Article 15 – Applicable law and disputes
1.All agreements between Lara Boutique and the consumer are exclusively governed by Dutch law.
2.Disputes will be submitted to the competent court in the Netherlands, unless mandatory law dictates otherwise.
3.The applicability of the Vienna Sales Convention (CISG) is excluded.
Article 16 – Final provisions
1.Lara Boutique reserves the right to amend these general terms and conditions.
2.The most current version of the general terms and conditions is always available via the Lara Boutique website.
3.If one or more provisions of these general terms and conditions prove to be invalid or voidable, the remaining provisions will remain in full force.
